Terms and Conditions

Last Updated: August 24, 2026

These Terms and Conditions (“Terms”) govern your access to and use of this website and its questionnaires, automated document-generation tools, downloadable documents, and related services (collectively, the “Services”).

The Services are intended to help users provide information and generate certain estate-planning documents, which may include a Last Will and Testament and related documents. Because laws governing wills and estates vary by state and may change, users must follow the execution requirements applicable in their own jurisdiction.

By using the Services, submitting information, generating or purchasing a document, or selecting an acceptance checkbox, you acknowledge that you have read, understood, and agree to these Terms.

1. Document-Generation Service

The Services use information supplied by you to populate or generate documents. The system does not independently verify the truth, completeness, legal effect, ownership, family relationships, beneficiary information, or other facts you enter.

You are responsible for reviewing every generated document before signing or relying upon it.

2. Not a Law Firm; No Legal Advice

Unless the website expressly identifies a separate attorney service and you separately enter into an attorney-client relationship, the automated Services are a self-help document-generation service and do not constitute legal representation or individualized legal advice.

General explanations, prompts, educational information, and automated document language are not a substitute for advice from a licensed attorney who can evaluate your particular circumstances.

3. No Attorney-Client Relationship

Using the website, answering questions, generating a document, paying for a document-generation service, or communicating with customer support does not by itself create an attorney-client relationship.

If attorney services are separately offered, an attorney-client relationship arises only under the terms of a separate engagement or representation agreement.

4. State Law Varies

Wills, testamentary documents, probate procedures, marital and spousal rights, community-property rules, elective-share rights, witness requirements, notarization rules, self-proving affidavit requirements, electronic-will laws, and other estate-planning rules vary among states and jurisdictions.

A document that is valid in one jurisdiction may require different language or execution procedures in another. You are responsible for selecting your correct state or jurisdiction and following the instructions applicable to that jurisdiction.

If you move, acquire property in another state, marry, divorce, have or adopt a child, experience a death in the family, or undergo another significant change, you should review your estate plan and consider consulting a licensed attorney.

5. Execution Requirements Are Critical

Generating or downloading a will does not make the document legally effective. A will generally becomes operative only after it is properly executed in accordance with applicable law.

Depending on the jurisdiction and circumstances, valid execution may require particular signatures, a specific number or type of witnesses, witnesses who are disinterested, notarization or a self-proving affidavit, physical presence or legally authorized remote procedures, and other formalities.

You are solely responsible for following the execution instructions and applicable law. Failure to properly sign, witness, notarize, or otherwise execute a document may cause all or part of it to be invalid.

6. Testamentary Capacity and Voluntary Action

The person making a will must satisfy the legal requirements for testamentary capacity under applicable law and must act voluntarily and free from improper coercion, fraud, or undue influence.

The Services cannot determine whether a user has sufficient legal capacity or whether undue influence, coercion, fraud, or other circumstances could affect the validity of a document. If capacity or undue influence may be an issue, consult a qualified attorney before executing any document.

7. User Responsibility for Accuracy

You are responsible for providing complete, current, and accurate information, including names, marital status, children and descendants, beneficiaries, fiduciaries, property information, and other requested facts.

Incorrect or incomplete information may result in a document that does not accomplish your intended result.

8. Complex Estates and Circumstances

Automated document generation may not be appropriate for every person or estate. You should consider obtaining individualized legal and tax advice if your circumstances involve substantial or complex assets, blended families, special-needs beneficiaries, disinheritance, business interests, property in multiple states or countries, trusts, tax planning, creditor concerns, pending divorce, family disputes, questions concerning capacity, or other unusual circumstances.

9. Beneficiary Designations and Non-Probate Assets

A will does not necessarily control all property. Assets such as life insurance, retirement accounts, payable-on-death or transfer-on-death accounts, jointly owned property, and trust assets may pass according to beneficiary designations, title, contract, or other law rather than under a will.

You are responsible for reviewing beneficiary designations and ownership arrangements separately.

10. Minor Children and Guardian Nominations

A will may permit a parent to nominate a guardian for minor children, but a nomination does not guarantee that the nominated person will be appointed. Courts generally retain authority to determine guardianship according to applicable law and the child's best interests.

11. No Guarantee of Validity or Outcome

We do not guarantee that a generated document will be admitted to probate, upheld against a challenge, achieve a particular tax result, prevent probate, avoid family disputes, or accomplish every intended legal result.

Courts, probate authorities, financial institutions, and other third parties make independent determinations under applicable law.

12. Changes in Law and Personal Circumstances

Laws may change after a document is generated. The Services do not undertake an ongoing duty to monitor your personal circumstances, notify you of legal changes, or update previously generated documents unless expressly stated otherwise.

You should periodically review your estate-planning documents and review them after major life or financial events.

13. Tax and Financial Matters

The Services do not provide tax, accounting, investment, or financial advice unless expressly stated otherwise. Estate, gift, inheritance, income, and other tax consequences can vary significantly. Consult appropriate professionals when tax or financial planning is relevant.

14. Automation and Artificial Intelligence

The Services may use software, templates, rules-based automation, or artificial intelligence to assist with questionnaires, educational content, and document generation. Automated systems can make mistakes or produce incomplete or inappropriate results.

You are responsible for reviewing generated content and seeking professional advice when necessary.

15. Electronic Wills and Electronic Signatures

Not every jurisdiction treats electronic wills, electronic signatures, remote witnessing, or remote notarization in the same manner. The availability of an electronic signature feature does not mean that electronic execution is legally sufficient in your jurisdiction.

Follow the specific execution instructions provided for your document and jurisdiction.

16. Storage and Original Documents

You are responsible for maintaining the final executed version of your estate-planning documents in a safe and accessible location and for informing appropriate persons where the original or legally operative document can be located.

The website does not act as a custodian of your original will unless a separate service expressly states otherwise.

17. Privacy and Sensitive Information

Information submitted through the Services will be handled according to the website's Privacy Policy. Estate-planning questionnaires may request sensitive personal and family information. Review the Privacy Policy before submitting information.

Information submitted to an automated document service is not automatically protected by attorney-client privilege.

18. Security

Reasonable measures may be used to protect information, but no online service, transmission method, or electronic storage system can be guaranteed to be completely secure.

19. Prohibited Use

You may not use the Services to create documents for fraudulent or unlawful purposes, impersonate another person, submit information without authorization, interfere with the website's operation or security, or reproduce or resell proprietary templates or systems without permission.

20. Intellectual Property

The website, software, questionnaires, workflows, text, templates, graphics, and document-generation systems may be protected by intellectual-property laws. Your right to use a generated document does not transfer ownership of the underlying software, templates, or proprietary systems.

21. Fees and Refunds

Prices, subscriptions, and refund terms will be disclosed at or before purchase. To the extent permitted by applicable law, digital-document purchases may become nonrefundable after generation, access, or download as stated in the applicable refund policy.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, appropriate for every user, or sufficient for every estate-planning need.

23. Limitation of Liability

To the fullest extent permitted by applicable law, the website and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Any additional limitation of liability should be interpreted according to applicable law.

24. Third-Party Services

The Services may link to or integrate with third-party services. We are not responsible for third-party content, availability, security, or practices.

25. Governing Law and Consumer Rights

Any governing-law, venue, dispute-resolution, or arbitration provision displayed by the website is subject to applicable federal and state law. Nothing in these Terms is intended to waive consumer rights or protections that cannot legally be waived.

Because the Services are offered nationwide, the website operator should obtain legal review before adopting a specific nationwide arbitration, class-action waiver, governing-law, or venue clause.

26. Changes to Terms

We may update these Terms from time to time. The version posted when you use or purchase the Services will govern that transaction unless applicable law requires otherwise.

27. Severability

If any provision is held invalid or unenforceable, the remaining provisions will continue to the fullest extent permitted by law.

28. User Acknowledgment

Before generating a document, the website may require the user to affirm the following:

“I have read and agree to the Terms and Conditions and Privacy Policy. I understand that this service generates estate-planning documents from information I provide and does not, by itself, provide individualized legal advice or create an attorney-client relationship. I certify that the information I provide is accurate to the best of my knowledge. I understand that laws and signing requirements vary by state, that generating a document does not make it legally effective, and that I am responsible for reviewing and properly executing the document according to the law applicable to me. I understand that I should consult a licensed attorney if I have questions about my circumstances.”

By selecting “I Agree,” generating a document, or otherwise using the Services, you agree to these Terms.

Website Implementation Note

For stronger evidence of assent, consider requiring an unchecked acceptance box immediately before the user generates or purchases a document, with conspicuous links to the Terms and Privacy Policy. Maintain an electronic record of the version accepted, date/time, and transaction or account identifier, subject to applicable privacy law.
